SIDEWALK AND CURB INSTALLATION 

Prior to laying, construction, reconstruction or alteration of either curbs or sidewalks by property owners, a property owner shall apply for a Curb and Sidewalk Permit Application, Specs and Flagger Policies in accordance with the regulations set forth in Article IV.   On July 11, 2011, Mount Joy Borough Policy for Determining Replacement or Repairs to Sidewalk and Curb became effective. On March 2, 2015, Mount Joy Borough amended Chapter 232, Article IV Streets and Sidewalks, to NOT allow downspouts and rain gutters to be placed within the sidewalk and/or curb.  This Ordinance also included amendments to trench restoration and backfilling specifications and inspection procedures.  Click here to view Ordinance 2-15.

WORK ZONE TRAFFIC CONTROL 

Any person performing any work on or near the roadway which may create a hazard, shall erect traffic control devices.  On March 14, 2011, Mount Joy Borough adopted a policy for work zone traffic control. Click here to view this policy.

On March 14, 2011, Mount Joy Borough adopted a Work Zone Traffic Flagger Training Requirements Policy, that any person or persons performing work in the Borough requiring flagging in a work zone meet the requirements set forth in this policy. Click here to view this policy.

SNOW & ICE REMOVAL (Article IV, Chapter 232-93)

The responsible party for a property fronting upon or along any street within the Borough is hereby required to remove or cause to be removed from all of the sidewalks in front of or along side such property all snow and ice which has fallen or formed thereon within twenty-four (24) hours after such snow and ice has ceased to fall, or to be formed so that there shall be a clear walk along the entire length thereof at least three (3) feet in width.  In the event that snow and/or ice on a sidewalk has become so hard that it cannot be removed without the likelihood of damage to the sidewalk, the responsible party shall, within twenty-four (24) hours after the snow or ice has ceased to fall or form, cause enough sand or other abrasive to be placed upon the sidewalk to make travel reasonably safe and shall, as soon thereafter as weather permits, caused to be cleared a path in said sidewalk of at least three (3) feet in width.

DEPOSIT OF MATERIALS ON STREETS OR OTHER PROPERTIES (Article II, Chapter 232-32)

It is hereby declared a public nuisance for any person, being the owner of real property or operator of any vehicle, to permit a vehicle entering from upon a public street, road, or alley or upon public property to deposit or track dirt, mud, rock or other material from such property.

DISPLAY OR STORAGE OF MERCHANDISE ON SIDEWALK (Article II, Chapter 232-29)

It shall be unlawful for any person to display or store any merchandise upon any sidewalk in the Borough unless such merchandise, including any stand, table or support therefor, shall extend not more than four feet from the building line toward the curb or outer line of the sidewalk and shall be not less than six feet in height.  (Main Street Mount Joy events are exempt from this section.)

PLACEMENT OF SCAFFOLDING, EQUIPMENT OR DUMPSTERS ON THE SIDEWALK OR STREET

The placement of scaffolding, equipment, dumpsters or other similar obstructions must be placed in accordance with Chapter 232-30 and Chapter 232-31.  A Temporary Street and Sidewalk Obstruction Permit is also required to be completed prior to placing any of these items on the sidewalk or street.  The proper signage must be displayed in accordance with the permit requirements.
